Internet bidding terms and conditions

PLEASE READ THESE TERMS AND CONDITIONS. WE HAVE MADE AN EFFORT TO KEEP THEM CLEAR AND SIMPLE, THEY CONTAIN MUCH USEFUL INFORMATION ON WHAT TO EXPECT WITH INTERNET BIDDING.

  1. Additional Service

Where possible bidders should attend the auctions in person, as this is the best way to be sure of getting your bids in and to be sure of exactly what is being bid for. Internet bidding is a service offered by Government Auctions SA so that people who cannot get to the auction can still participate. The Internet is prone to slow downs and outages and so both Government Auctions SA and Interbid wish to warn users that it may not be possible to bid over the Internet at an auction.

  2. Auction Information

Intending bidders need to be aware of the information about the auction published in the paper and available from the website, in particular the methods of payment and times of inspection and collection.

  3. Government Auctions SA - Terms and Conditions of Sale

These terms and conditions of Internet bidding are in addition to Government Auctions SA's terms and conditions of sale, which are available from the auction room. In particular bidders should note that the vehicles offered for sale "as is" , in its present condition without any representations or warranties of any kind or nature, as all lots are available for inspection prior to the auction.

  4. Goods and Services Tax (GST)

Vehicles will in some cases be auctioned at a GST exclusive price and in other cases will be auctioned at a GST inclusive price. If a vehicle is auctioned at a GST exclusive price then if the whole or any part of the purchase price is the consideration for a taxable supply pursuant to the A New Tax System (Goods and Services Tax) Act 1999 (Act), the successful bidder (i.e. the purchaser) agrees to pay any GST referable to the GST exclusive sale price if they are an individual and if the purchaser is a business, GST will be added to the GST exclusive purchase price and also to all charges and fees. The auctioneer will provide to the purchaser (if applicable) a tax invoice pursuant to the Act at the same time at which any GST is payable.

  5. Special Conditions

Government Auctions SA makes no representation as to title of any motor vehicle and Government Auctions SA cannot and does not warrant or guarantee the accuracy of anything contained in any vehicle inspection report and accordingly Government Auctions SA accepts no liability or responsibility for any losses or damages experienced through the use of this auction website, nor shall Government Auctions SA be held liable for any negligence, special, incidental or consequential damages or for loss, damage, or expense directly or indirectly arising and is indemnified by the purchaser against any actions, claims and demands.

  6. Auctioneers Discretion

Government Auctions SA has total discretion in choosing to accept a bid from the Internet or from the floor and may, without giving any reason, refuse to accept the bidding of any person or persons. Because reserves are kept totally secret even placing a limit well ahead of time does not improve a bidders chances of being selected for key bids. If you can, it's always best to attend the auctions in person.

  7. Collection of Information

The purchaser acknowledges and accepts that the following information may be collected by Government Auctions SA - email address, first and last name or business name, ACN, address, phone number, driver's licence, credit card details.
